Judicial Practice

The vast majority of conflicts, especially those that have become legal, arise from a failure to honor agreements. Unfortunately, we have to admit that these agreements themselves are often impossible to fulfill. They were made as a basis for further negotiations on new agreements but on more favorable terms. In the worst case, the parties did not intend to fulfill such agreements in the first place.

In this case, agreements should be understood in the broadest sense of the word. It can be a verbal agreement between business partners, a contract between a supplier and a buyer, or an employee and an employer, or it can be part of the social contract under which we all agree to work in our country, which in turn provides us with social guarantees and protection of our rights and legitimate interests.
When the agreements are not fulfilled and the arguments for further negotiations have run out, it is necessary to turn to a third party, in this case, the court.

One may have different opinions about the implementation of the rule of law in our country, but the fact remains that in Ukraine there is no real alternative to the judicial system for resolving the vast majority of conflicts and disputes.

When faced with the judicial system, it is highly desirable to understand how it actually works. In addition to the legal requirements for the content of the claim, payment of the court fee, confirmation of the party's authority to proceed, and other formalities, it can be crucial to have up-to-date information on the latest Supreme Court practice in this category of cases. Knowing the judge's health and holiday schedule, and understanding his or her legal and political views, can be crucial to success.

Experience teaches you to question everything that happens in the process, to double-check every fact, and to be constantly prepared for any force majeure.
